Waste law

 

The world of waste develops very quickly. The ink of the new European Directive on Waste isn't dry yet or the next change is upcoming. In some places bio-fuel-factories are shut, but in the same time new are opened only 50 kms further away. Household or city waste is being burnt hundreds of kilometers away, while an oven is nearby. Some Dutch ovens have got the R1-status. Burning waste means "recovery of waste" there, although this can't be called cradle-to-cradle (C2C) ofcourse. 

Meanwhile waste is being seen more and more as a "resource". Recycling is in the spotlights more than ever. The implementation of the new Directive in the Dutch law can have positive effects for some products like scrap metals, aggregates, tyres, textiles, compost, waste paper and glass.

What will the "end-of-waste-status" mean in practice? Will the problems with mixed waste finally be solved? Wich possibilities has the European Legislative Resolution on shipment of waste (EVOA) outside the EU?

De WABO: onleesbaar & onnodig ingewikkeld, maar wel essentieel

Op 1 oktober 2010 is het dan eindelijk gebeurd. De Wet algemene bepalingen omgevingsrecht (WABO) is ingevoerd. Een zeer grootscheepse juridische reorganisatie van het rechtsgebied "Ruimelijke Ordening en Milieu".

Maar liefst 25 vergunningstelsels zijn onder één noemer gebracht. Eén nieuwe procedure voor (bijna) alle denkbare vergunningen. Alle gemeenten en provincies gaan uniform werken.

Eén vergunning. Eén bevoegd gezag. Eén uitgebreide procedure of gewone procedure.

Vanaf 1 oktober 2010 heet dit rechtsgebied kortweg "omgevingsrecht". Alle vergunningen die u nu nog bij naam kent, zoals bouwvergunning,milieuvergunning, kapvergunning enz. heten dan "omgevingsvergunning".

Voor ondernemers die te maken hebben met deze vergunningen, is het raadzaam dat u zich goed informeert. De WABO had namelijk dan wel tot doel om e.e.a. simpeler en duidelijker te maken; de werkelijkheid is dat de WABO een soms haast onleesbaar en onnodig ingewikkelde wet is. Maar wel een essentiële wet.
